Orang gopoh tak mampu bertahan dalam jemaah.

Media talibarut BN yang selama ini menuduh PAS sesat, menyeleweng dan mengikut telunjuk DAP dan KeADILan, tiba-tiba memfokuskan isu bahawa Dr Hasan dizalimi dan tidak diberi hak membela diri lalu dipecat daripada PAS.

Sepatutnya mereka gembira kerana Hasan telah keluar dari parti yang menyeleweng’.

Samalah seperti sebelum ini media-media talibarut BN sentiasa mendakwa PAS sebagai membawa versi negara Islam yang menyeleweng.

Sebaliknya Umnolah kononnya yang memperjuangkan negara Islam sebenar lalu mengisytiharkan Malaysia sebagai sebuah negara Islam, sekalipun ‘negara Islam’ Umno itu menolak hukum Allah.

Hampir separuh abad PAS dituduh berpura-pura menegakkan negara Islam atau negara Islam versi PAS tidak betul. Apabila tibatiba PAS menyebut negara kebajikan dan bukan negara Islam, maka mereka menuduh PAS sudah menyeleweng kerana meninggalkan hasrat menegakkan negara Islam.

Bukankah sepatutnya jika mereka menganggap konsep negara Islam PAS tidak betul, maka mereka akan menyokong PAS meninggalkan perkara ‘tidak betul?’

24 JAN — Negara kita ini adalah sebuah negara Persekutuan (federation) dan bukannya sebuah negara ‘unitary’. Putrajaya itu bukan pusat pentadbiran kerajaan pusat tetapi pusat Pentadbiran Kerajaan Persekutuan Malaysia. Persekutuan kita terbentuk pada 2hb Februari 1948 dalam mana kesebelasan negeri-negeri yang berada dalam Semenanjung menandatangani perjanjian untuk bersatu dan membentuk sebuah persekutuan yang dinamakan Persekutuan Tanah Melayu (PTM).

Justru, kesemua negeri-negeri bersekutu dan tidak bersekutu serta dua buah negeri Straits Settlement Pulau Pinang dan Melaka membentuk sebuah persekutuan yang berpusat di Kuala Lumpur. Tidak perlu diulangi bagaimana persekutuan ini terbentuk kerana sudah terlalu banyak saya tulis sejak 3 tahun yang lepas. Tetapi yang penting di sebut pada hari ini ialah negeri-negeri merupakan negeri-negeri yang berlainan di bawah jajahan Raja-Raja nya dan kerajaan mereka sendiri.

Tetapi dengan wujudnya Persekutuan Tanah Melayu itu, negeri-negeri Sembilan negeri yang beraja dan dua negeri selat itu bersatu di bawah sebuah persekutuan. Maka selepas merdeka wujudlah sebuah negara persekutuan yang berdaulat dan tentunya kedaulatan kerajaan persekutuan itu datangnya dari kedaulatan negeri-negeri di dalam persekutuan itu.

M Faqih | 08 Feb 2012 : KOTA BHARU, 8 Feb : Kewibawaan Datuk Seri Mustapa Mohamed kini semakin terjejas apabila secara berterusan mengeluarkan kenyataan tidak berasas dan ‘membohongi’ rakyat Kelantan.

Ketika kempen pilihan raya kecil Dun Manek Urai pada Julai 2009 Menteri Perdagangan Antarabangsa dan Industri itu mendakwa Kelantan tidak berhak ke atas royalti minyak kerana pelantar minyak terletak di kawasan bertindih. Namun tidak lama selepas itu Perdana Menteri, Datuk Seri Najib Razak membayar royalti yang ditukar menjadi wang ehsan dan dibayar melalui Jabatan Pembangunan Persekutuan. Malah ketika berucap di Dewan Undangan Negeri Kelantan pada 24 November 2007 Mustapa pernah mengakui turut terbabit menyekat peruntukan pusat kepada Kelantan.

Dan baru-baru ini pula mendakwa pinjaman RM600 juta bagi meningkatkan bekalan air diberi kepada Kelantan secara percuma tanpa perlu dibayar balik. Ketua Pemuda PAS Kelantan, Abdul Latiff Abdul Rahman mempersoalkan mengapa Ketua Umno Jeli itu sanggup memperjudikan segala kepentingan rakyat demi masa depan politiknya. “Kenyataan itu merupakan satu pembohongan yang sangat jelas. Saya hairan bagaimana sebagai Pengerusi Umno Kelantan tergamak mengeluarkan kenyataan yang sangat tidak benar. “Sebagai seorang menteri, amatlah tidak logik jika beliau mendapat maklumat yang salah. Layakkah seorang pembohong ditabal sebagai pemimpin. “Perlu ingat pinjaman RM600 juta yang diberi itu bukannya percuma, bahkan ia merupakan pinjaman yang perlu dibayar,” katanya di sini.

Pada 5 Febuari lalu Mustapa dilapor mendakwa RM600 juta diberi kepada Kelantan bagi meningkat pengurusan bekalan air diberi secara percuma, namun masih gagal menyelesaikan masalah air. Menurutnya duit sebanyak itu kalau dipinjam di bank akan dikenakan kadar faedah tujuh peratus, tetapi mereka dapat percuma.

Abdul Latif berkata, tindak tanduk Mustapa secara tidak langsung menjatuhkan imej Umno Kelantan yang bercita-cita mahu merampas negeri ini pada pilihan raya umum ke-13. Sementara itu dalam perkembangan sama orang ramai di Jeli melahirkan rasa terkejut kenyataan anggota parlimen kawasan berkenaan yang secara terang-terangan disifatkan membohongi rakyat Kelantan.

Seorang penduduk memberitahu mereka tidak teragak-agak membuat laporan polis terhadap pemimpin terbabit kerana cuba menipu rakyat Kelantan dengan fakta salah.

Tok Pa feeler to Ku Li: Overture or ploy?

By Terence Netto | COMMENT Umno dissident Tengku Razaleigh Hamzah has shadowed his party like a solitary Red Indian on the surrounding hills tracking a posse of cowboys in the valley below as in a western movie.

From time to time, the posse would signal to the scout to come down to parley but the overture is akin to sending up smoke signals in a high wind.

Garbled in transmission, the missives are neither spurned nor studied, with both sides warily opting to resume their uneasy reconnoitering.

The latest feelers put out by Kelantan Umno chief Mustapa Mohamed are couched in similarly ambiguous vein.

National news agency Bernama quotes Mustapa, who is international trade and industry minister, as acknowledging Razaleigh’s vast influence in the nation’s politics and in Kelantan.

He said his inputs were needed to recapture the state from PAS.

“We will ask for Ku Li’s (Tengku Razaleigh’s) advice on how Kelantan Umno can step up its efforts for the task,” said ‘Tok Pa’, as the minister is popularly referred to in Umno circles.

Long wait for the top spot

Razaleigh, whose longevity in state and national politics has spanned four decades, is imperturbable in the belief it is his manifest destiny to be prime minister of Malaysia.

It was a sense of noblesse oblige that saw him defer to retiring Prime Minister Hussein Onn’s advice he not challenge Hussein’s choice of Dr Mahathir Mohamad as his successor in 1981.

Go for the deputy presidency of Umno in the party’s polls that year, was Hussein’s advice.

‘Ku Li’, a term of endearment for the Kelantanese prince, was then the most popular leader in Umno – the top post was his for the taking.

He had been its top vice-president for six years, and was ready at 43 to assume the prize for which he had been honed when as a precocious economics graduate he was made chief executive of Bank Bumiputra, incubator of Malay entrepreneurial success, and later the top man in Petronas, the oil corporation that was the main driver of national economic growth.

Such were the formidable spawning grounds of manifest prime ministerial destiny that Razaleigh felt he enjoyed a matchless edge in the succession sweepstakes, if not in 1981 then much later.

As someone in his early 40s, he felt he could afford to wait. Ambition’s fulfillment was adjourned sine die, as they say in parliamentary parlance.

And what an indefinite adjournment it was!

The Mahathir interregnum went on and on, not only sidetracking Razaleigh, but also shelving three deputy prime ministers – Musa Hitam, Ghafar Baba and Anwar Ibrahim – before Abdullah Ahmad Badawi reached the top of the greasy pole, only to plummet precipitately in less than the time Hussein had had served as the country’s third PM since Independence.

Attainment and occupation of the prime ministerial office is a dicey business, but unlike the numbers that come up on a roll of a dice, it does not occur at random.

It is composed in several parts of ambition and in some of cold insistent passion, allied of course to able mastery of political fact and maneuver.

It’s his reading of the latter datum that is the basis of Razaleigh’s stance of the last four years – a unifying above-the-fray statesmanship – that sees electoral politics sliding into a hung Parliament at the conclusion of 13th general election.

In that hypothetical impasse, Ku Li sees himself as focal point of a government of national unity, incorporating liberal dissidents within Umno-BN, like him, with national concord-desiring elements of Pakatan Rakyat, after the toxic divisiveness of the last decade and half of the Malaysian political saga.

Umno likely to drop Ku Li

For the panning out of that scenario, Razaleigh has to hold on his MP-ship of the seat of Gua Musang in southern Kelantan, something he cannot be sure of if PAS does not give him its tacit backing through the withdrawal of their candidate in the event Umno drops him from its list of nominees.

Razaleigh would then have to stand as an independent, a stance that would only be successful if the contest is a two-cornered fight between him and the Umno nominee, with PAS pulling out.

From that angle, Mustapa’s invitation to Razaleigh to collaborate with Umno is seen as an attempt to induce him away from being a PAS proxy in the upcoming elections, a maneuver fraught with complications for Ku Li who has endorsed the PAS-led government’s claim to royalties on oil mined off the coast of the state, now the subject of a court battle and the sore sticking point in state-federal relations.

Tok Pa’s invitation to Ku Li can be summarised as ‘we want your collaboration for control of Kelantan, your espousal of its economic interests be damned.’

In other words, they want collaboration without representation, an oxymoronic position which Kelantan’s favoured-son is too principled and too savvy to fall for.

Razaleigh would view Mustapa’s transparently partisan play for his collaboration as emblematic of all that is wrong in state and national politics and his leadership of a hypothetical government of national unity as prescription for the malady.

Hence Ku Li’s reaction would be – nice try Tok Pa, but no thanks. – Mkini

The Atomic Energy Licensing Board announced late on Wednesday it would grant Lynas a license to operate the first rare earths plant outside China in years, despite public protests over fears of radioactive pollution.

It said Lynas must submit plans for a permanent disposal facility within 10 months and make a $50mn financial guarantee. Malaysia hopes the Lynas plant will spur growth. But the project has been the subject of heated protests over health and environmental risks posed by potential leaks of radioactive waste.

Feb 2: Amid the controversy about the 1Malaysia Book Vouchers being sold for cash by students,

PAS Youth chief Nasrudin Hassan said it was bad execution which rendered the plan ineffective.

The RM200 book vouchers given to every student ranging from Form Six to university-level formed part of prime minister Najib Razak’s 2012 budget to lessen their financial burden in purchasing reference books.

Recent reports on students selling away the vouchers irked the Higher Education ministry, with minister Khaled Noordin urging police to act against students who sold their vouchers.

"The students must be made responsible for their wrong-doings," said Khaled.

Nasrudin however cited poor timing as the reason for the problem.

“The vouchers were distributed right after students had completed their final exam. These students will then go for long vacation. The vouchers are valid till March 31, 2012.

"Against this backdrop, the vouchers are ineffective unless the expiry date can be extended to a reasonable date,” said Nasrudin.

'Time it for Book Fair'

The Pahang PAS deputy commissioner proposed that the expiry date be aligned with the start of the new semester or during the International Book Fair slated in April.

The time validity of the vouchers, said Nasrudin, was the real reason why some chose to exchange the vouchers for cash.

He also also urged the government to think of more ways to help students.

“In Islam, it is compulsory for the government to give free education to the people, not a one-off payment like the vouchers,” he added.

Granting Lynas Corp a license to operate is simply allowing them to treat people like lab rats, says Kuantan MP Fuziah Salleh.

PETALING JAYA: Kuantan MP, Fuziah Salleh, believes that an unseen but powerful hand was behind the granting of a temporary operating licence (TOL) to Lynas Corp.

The Australian mining giant received its long awaited TOL today following the Atomic Energy Licencing Board’s (AELB) meeting on Monday.

The TOL is however subjected to five conditions and a breach of any one of them would result in the suspension or revocation of the licence.

Three of those five conditions insist that Lynas disclose the details of its Permanent Disposal Facility (PDF) and take full responsibility of waste management which includes sending it back to the original source if necessary.

Not a single detail of the PDF was included in Lynas’ Radioactive Waste Management Plan (RWMP) which was available for public viewing for three weeks last month.

Most of the public feedback questioned the vagueness of this facility and Lynas’ plan to recycle and commercialise the residue.

Fuziah, who is Lynas’ strongest detractor, pointed out that AELB’s insistence on more details of the PDF was a confirmation that Lynas’ RWMP is flawed and incomplete.

“These are loopholes not conditions,” she told FMT in an immediate reaction.

“The fact that AELB said it would revoke the TOL if Lynas doesn’t meet these conditions shows that they know the licence shouldn’t have been issued in the first place.

“Their conditions are incongruent with their decision. Hence why I believe that both AELB and Mosti are under tremendous pressure or instruction by an unknown source to approve this licence.

“No responsible government would allow its people to be treated like lab rats,” she said.

Groups to file suit

Fuziah said that anti-Lynas groups would now proceed with a judicial review of AELB’s decision and would likely file a suit within a week.

SPR alih isu pokok laksana lapan tuntutan

KUALA LUMPUR 1 Feb: Menghentikan amalan perarakan pada hari penamaan calon seperti yang diputuskan Suruhanjaya Pilihan Raya (SPR) bukan isu pokok yang dituntut rakyat, kata Timbalan Pengarah Pilihan Raya KEADILAN, Datuk Dr Mansor Othman.

Beliau mengulas kenyataan Ketua Umum KEADILAN, Datuk Seri Anwar Ibrahim hari ini yang mengingatkan SPR supaya memberi tumpuan utama membersihkan pilihan raya dan bukan isu-isu yang remeh.

Kenyataan Anwar itu ekoran laporan akhbar The Star bahawa SPR akan menghentikan amalan mengadakan perarakan pada hari penamaan calon pilihan raya.

“SPR cuba mengalih isu pokok yang kita tuntut selama ini dengan keutamaan kita ialah membersihkan daftar pemilih.

“Selagi isu teras ini tidak diselesaikan rakyat kekal melihat SPR berpihak kepada pemerintah dan sistem pilihan raya di negara ini berat sebelah,” katanya yang juga Naib Presiden KEADILAN.

Menurut Dr Mansor, isu utama yang diberi penekanan oleh Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) serta Pakatan Rakyat selama ini ialah kelapan-lapan tuntutan mereka.

Ia termasuk mereformasikan undi pos, penggunaan dakwat kekal, kempen minima 21 hari, akses media yang adil untuk semua parti bertanding, mengukuhkan institusi awam serta menghentikan politik kotor dan rasuah.

Walaupun SPR katanya bersetuju menggunakan dakwat kekal, namun agensi kerajaan itu masih berdolak-dalik berhubung tujuh tuntutan yang dikemukakan Bersih.

Mengenai kenyataan Pengerusi SPR hari ini bahawa 42,025 nama pengundi sudah digugurkan, beliau berkata SPR juga perlu melaksana cadangan yang dikemukakan Jawatankuasa Pilihan Khas Parlimen (PSC) untuk Penambahbaikan Proses Pilihan Raya.

“Lagipun, nama yang digugur itu hanya nama yang gagal disahkan Jabatan Pendaftaran Negara (JPN), sedangkan banyak lagi nama yang disahkan oleh JPN tetapi ada masalah,” katanya kepada Keadilandaily.com.

Sehubungan itu, katanya, SPR perlu melaksana segala tuntutan Bersih dan cadangan PSC sebelum berlangsungnya Pilihan Raya Umum (PRU) ke-13.

“Jika SPR enggan, jangan salahkan rakyat jika mereka masih melihat SPR sebagai badan berpihak untuk memenangkan parti pemerintah,” tegasnya.

Lynas receives ‘conditional’ licence to operate.

AELB warns Lynas Corp that it will not hesitate to suspend or revoke the licence if the conditions are not met.

PETALING JAYA: The Atomic Energy Licencing Board (AELB) and the Science, Technology and Innovation Ministry (Mosti) have granted Lynas Corp its long awaited temporary operating licence (TOL) for its rare earth plant in Gebeng.

In a joint media statement this evening, AELB and Mosti said that the decision was made after taking into consideration public views and feedback on Lynas’ application permit.

The 300-page document was displayed for public viewing for three weeks beginning January 3 at various locations in Selangor and Pahang.

According to AELB, 334 people viewed the documents and 1,123 feedback forms were submitted as of January 26. The Board met on Monday where the decision to award the TOL to Lynas was made.

Remember Perak

Before Malaysia really becomes the world's laughing stock, it is up to all Malaysians and not just Perakians to boot out BN.

There has been widespread rumours that Parliament will be dissolved anytime in February with Feb 6 being bandied about as one of the likely dates to pave the way for polling on March 11 (there seems to be a general consensus on this March date for the polls from various sources). This goes to explain the heightened political activity in Perak from late last year till the present.

The recent big activity in Perak is, of course, the National Chinese New Year Open House celebration hosted by Prime Minister Najib Tun Razak in Sitiawan on Jan 28. It is just too much of a coincidence that Perak is hosting this big event. Something is on the boil and yes, many are already saying that the continuous presence of Barisan Nasional bigwigs in Perak is an indicator that polls will be held very soon.

In the meantime, Perakians will be “celebrating” two dramatic anniversaries in February:

Feb 5 – the third anniversary of the fall of the Pakatan Rakyat state government; and

Feb 9 – the second anniversary of Umno’s Zambry Abdul Kadir being declared as the menteri besar by the Federal Court who upheld the Court of Appeal’s decision via a 5-0 verdict in favour of the Umno man.

A quick recap on how the Perak power-grab came about. Just before the Chinese Lunar New Year of 2009 (Year of the Ox) at around the third week of January, Umno’s state assemblyman for Bota, Nasarudin Hashim, jumped over to PKR and this triggered off a string of defections and dramatic events that would be instrumental in the downfall of Perak.

The main event was the disappearance of three Pakatan lawmakers who suddenly became incommunicado with their party leaders only to appear several days later at a press conference together with the then deputy prime minister Najib Tun Razak to declare that they were BN-friendly.

‘Borneo alliance’ agreed in principle

Sabah Progressive Peoples' Party (SAPP) asks for more time to weigh its participation in the Borneo alliance.

KOTA KINABALU: An inaugural meeting to form a United Borneo Alliance (UBA) succeeded only to have an “agreement in principle” as one of the participants, the Sabah Progressive Party (SAPP), wanted time to deliberate on it before formalising their participation.

The meeting yesterday saw the participation of representatives from three local groupings – State Reform Party (STAR), SAPP and the yet-to-be-registered Usno Baru.

It was chaired by Ismail Gimbad, 71, a former Sorob (now Kadamaian) assemblyman who is not a member of any of the parties.

Though the Sabah Peoples’ Front (SPF) was not represented, the meeting’s main proponent, Jeffrey Kitingan, who heads the Sabah chapter of STAR, considered it a success nevertheless.

“It was a successful meeting as we have agreed in principle on the concept of co-operation and alliance to face the general election.

“SAPP deputy president Amde Sidek has to brief his party supreme council first for endorsement to be part of this alliance,” Kitingan told FMT after the two hour meeting which was surprisingly shunned by the local media.

Amde, when contacted, declined to comment.

No show by BN partners

According to Kitingan, UBA is an alliance or grouping of individually registered or established organisations that wish to come together as allies or friends in the pursuit of a common cause.

“The common objective of UBA is to defeat the current Umno/BN regime and as a group, take over the government, whether state or federal.

“Membership is open to Sabah and Sarawak-based political parties, and autonomous Peninsular-based parties, while leadership is by consensus,” he said.

Hasan Ali to form new NGO called ‘Jati’

SHAH ALAM, Jan 31 — Fresh from his sacking from PAS, Datuk Dr Hasan Ali has decided to start a new non-governmental organisation called “Jati” to continue defending Islam, Malay rights and the Malay Rulers.

According to Bernama Online, Hasan (picture) described his new political platform as a “third force”, claiming its formation was necessary to help determine who should form the next government.

But, said the report, the former Selangor state executive councillor was yet to decide if Jati would be pro or anti-government.

“We are the ‘third force’ and will contest on this premise and are not bothered whether we compete with or against political parties,” he was quoted as saying in the article.

Hasan however added that he still loved PAS and would continue efforts to rid the party of the “parasites” he alleged are attempting to destroy its Islamist struggle.

Hasan was axed from the party after he persistently undermined PAS's leadership.

KLUANG (Jan 30, 2012): Malaysia today called for its two citizens held at the Guantanamo Bay detention centre since 2006 to be brought before a US military tribunal as soon as possible.

Home Minister Datuk Seri Hishammuddin Tun Hussein said the detention of the duo without trial shows that the Western country does not practise what it preaches in the matter of human rights.

"We hope that they (the Malaysians) will be brought before a military tribunal as soon as possible. We are often accused of not being independent, our judicial system is said to be not independent. But, I wish to state that we have two citizens being held (at Guantanamo) without trial for several years," he told reporters in Kampung Gajah, here.

Hishammuddin said what the Western country did in the case of the detention of the two Malaysians without trial was inconsistent with what it preached on the issue of human rights.

"We are often accused of being unjust," he said.

It was reported recently that the two Malaysians -- Mohd Farik Amin and Mohd Nazir Lep -- held at the Guantanamo Bay detention centre were expected to be brought before a military tribunal in the United States soon. - Bernama

Kuala Krai MP Dr Hatta Ramli is confident that the 13th GE will be held in March.

SEREMBAN: PAS is of the view that Prime Minister Najib Tun Razak will dissolve Parliament in early February and call for the 13th general election on March 11.

PAS central election department director Hatta Ramli said that would leave political parties with only 50 days to ready themselves for the polls.

“Based on my Umno insider information, Najib will dissolve Parliament in early February. Nominations will be held either on 25th or 26th and we will have two weeks campaign period before we cast the votes on March 11.

“So we only have another 50 days to work. There is not much time left for us to sit and relax,” the Kuala Krai MP told a 500-strong crowd during the opening ceremony of the Lenggeng PAS election operations centre here.

Hatta’s claim is strengthened by the fact that the first term school holidays for 2012 is from March 10 to 18.

If indeed the polls are held in March, then it is likely that the schools would be used as polling centres and many school teachers would be recruited as temporary Election Commission staff.

Lenggeng is one of the state seats that fall under the Seremban parliament seat. Pakatan Rakyat won Seremban and all state seats within Seremban in the 12th general election except the Lenggeng state seat. PAS loss Lenggeng to Barisan Nasional’s Mustafa Salim.

‘Political gimmick’

Meanwhile, at the same function Seremban MP John Fernandez had the crowd in stitches when he described the proposal by the Anti-Corruption Advisory Board for Cabinet ministers, including their spouses and children to declare their assets to the Malaysian Anti-Corruption Commission (MACC) as akin to “a father declaring his assets to his children”.

“This is a big joke. If the prime minister and his cabinet minister are really transparent please declare your assets to the public like how Penang Chief Minister Lim Guan Eng and his exco members made public their assets. You can even access (details) through the state government website.

“MACC is just another government department. For me this is merely a political gimmick by the government since the 13th general election is around the corner,” he said.

Also present was Negeri Sembilan PAS commissioner Mohd Taufek Abdul Ghani, PKR supreme council member and Seremban PKR deputy chief Dr Mohamad Rafie Abdul Malek and Seremban PAS chief MK Ibrahim Abdul Rahman.

Wan Zahidi (right) said the Federal Territory Islamic Law Consultative Committee (JPHSWP) found nothing wrong with the act of using zakat funds to pay for legal fees involving those discharging their official duties, claiming them as being among those who are 'striving in the way of God', or jihad fi sabilillah.

Referring to the Federal Territory Islamic Religious Council's approval of using zakat money to pay for legal costs, Wan Zahidi said: "JPHSWP had applied the opinions of ulama who interpreted asnaf fisabilillah (zakat-deserving category of those striving in the way of God) as covering a wider scope and not just for jihad," he was quoted as saying by Bernama.

His answer is the first such response from a mufti over allegation that Jamil, Federal Territory Religious Department (JAWI) director-general Che Mat Ali and Shariah chief prosecutor Shamsuddin Hussain used zakat money to pay their lawyers representing them in a suit by Opposition Leader Anwar Ibrahim.

Anwar, who was acquitted by the High Court on Monday of the sodomy charge, had earlier sued the trio for their inaction over his qazaf (false accusation of illicit sex according to Shariah) complaint against sodomy accuser Saiful Bukhari Azlan.

PAS melencong perjuangan asal?

Datuk, akhir-akhir ini selalu sangat orang memperkatakan bahawa PAS telah melencong daripada perjuangan asalnya. PAS didakwa meninggalkan Islam dan telah tidak lagi memperjuangkan Negara Islam dan berubah kepada Negara Berkebajikan. Ini tidak pernah disebut oleh pemimpin PAS terdahulu. Saya keliru kerana diulang-ulang dan disebut oleh media masa, sedangkan yang menyanggahnya jarang kedengaran. Apa pandangan dan nasihat Datuk kepada orang-orang seperti saya supaya teguh berdiri bersama PAS? Terima kasih Datuk.

Penyokong PAS Tegar, Dungun, Terengganu.

PIHAK yang memperkatakan kononnya PAS telah melencong dan terbabas dari perjuangan asalnya, dengan meninggalkan Islam dan berbagai-bagai lagi, adalah dakwaan media massa yang memusuhi perjuangan PAS.Tugas utama mereka adalah untuk mempromosikan parti pemerintah dan memburuk-burukkan lawannya terutama PAS. Dengan apa mereka hendak memburuk-burukkan PAS?

Itulah kerja media yang tidak senang dengan PAS. Selagi PAS teguh memperjuangan Islam, selama itulah Umno-Barisan Nasional tergugat dan akhir-akhir ini semakin tergugat. Oleh kerana itu mereka berusaha melemahkan PAS dengan apa cara pun.

Sebenarnya PAS tidak melencong atau menyeleweng dan jauh sekali daripada berubah dari Islam kepada yang tidak Islam. Mana mungkin PAS hendak berubah kepada yang tidak Islam.

Bukti yang paling nyata, Perlembagaan PAS yang ada sekarang, jelas tidak ada sebarang perubahan dan tidak pernah ada cadangan untuk berubah.

Perlembagaan PAS, Fasal 1, nama pertubuhan disebut Parti Islam Se-Malaysia (PAS).

Pada Perlembagaan PAS, Fasal 3, tujuan PAS ialah:

(i) Memperjuangkan wujudnya dalam negara ini, sebuah masyarakat dan pemerintahan yang terlaksana di dalamnya nilai-nilai hidup Islam dan hukum-hukumnya menuju keredaan Allah.

Di dalam PAS ada Majlis Syura Ulama, yang di antara tugas utamanya, seperti yang termaktub dalam Perlembagaan PAS, Fasal 7 (B):

“Mengeluarkan arahan dan perintah, supaya dasar dan ketetapan itu, dipatuhi dan dilaksanakan oleh mana-mana pihak atau badan di dalam PAS dan mengawasi serta memelihara, supaya dasar dan ketetapan serta kehendak-kehendak di dalam Perlembagaan ini dipatuhi dalam kegiatan gerakan dan pentadbiran PAS.”

Semua yang saya nyatakan berjalan lancar dan berada dalam keadaan baik, tanpa berlaku penyelewengan dan kelencongan.

Pihak yang menyatakan PAS sudah melencong dan berubah dasar perjuangannya, meninggalkan Islam dan Negara Islam dan bermacam-macam lagi, adalah suatu fitnah jahat yang semata-mata bertujuan memburuk-burukkan pejuang-pejuang Islam, yang dilakukan oleh musuh-musuh Islam, sepanjang zaman.

PAS tidak berubah dan tidak pernah mengubah dasar-dasar utama perjuangannya. Taktik dan strategi boleh berubah mengikut keperluan.

Apa yang disebut Negara Berkebajikan menggantikan Negara Islam, itu sebenarnya istilah. Maknanya sama dan tidak berubah.

Malah menamakan Negara Islam dengan nama Negara Berkebajikan, tidak bercanggah dengan Islam.

Di dalamn al-Quranul karim tidak terdapat istilah Negara Islam secara jelas dan terang. Yang ada seiras dengannya adalah istilah ‘Baldatun Tayyibah’ sebagaimana firman Allah (mafhumnya): “Sesungguhnya adalah bagi penduduk negeri Saba’, ada suatu tanda kemurahan Allah yang terdapat di tempat tinggal mereka, iaitu dua bidang kebun yang luas lagi subur yang terletak di sebelah kanan dan kiri. Lalu dikatakan kepada mereka itu, makanlah daripada rezeki pemberian Tuhan kamu dan bersyukurlah kamu kepada-Nya dan negeri kamu itu adalah negeri yang Tayyibah (Baik atau berkebajikan) dan Tuhan kamu adalah Tuhan Yang Maha Pengampun.” (Surah Saba’ ayat 15)

Ketika Presiden PAS membentangkan istilah Negara Berkebajikan dalam muktamar yang lepas (Jun 2011), tidak ada sesiapa pun yang meragui istilah itu dan tiada sesiapa pun yang mempersoalkannya di dalam muktamar.

Biasanya, jika ada sesuatu yang tidak kena, ahli dalam muktamar PAS akan menimbulkan berbagai pandangan, teguran dan bangkangan. Yang ternyata muktamar telah menerima.

Apabila ini berlaku, maka ianya adalah sesuatu selaras dengan perjuangan PAS.Penyebar-penyebar fitnah ke atas pejuangpejuang Islam, bukan perkara baru, malah sejak dari zaman sahabat Rasulullah s.a.w, yang memperjuangkan Islam pada waktu itu, musuh-musuh Islam dari kalangan musyrikin dan munafikin, telah menyebar fitnah yang lebih besar.

Antaranya dahulu, mereka menyatakan, ‘Muhammad adalah ahli sihir, dia gila, pembawa cerita dongeng, pemecah perpaduan umat Arab, dia menyembah berhala (Kaabah).’ Berbagai-bagai lagi fitnah dilemparkan terhadap Nabi s.a.w dan para sahabat baginda.

Oleh yang demikian, anda tidak harus mengendahkan media-media musuh Islam yang memang itu kerja mereka.

PAS sekarang, tetap PAS seperti dahulu, tetap memperjuangkan Islam yang syumul, tanpa menghiraukan kata-kata orang menentang.

Berpandulah kepada hadis Rasulullah s.a.w (mafhumnya): “Akan sentiasa wujud di kalangan umatku segolongan orang-orang yang memperjuangkan Islam yang sebenar, tanpa menghirau celaan orang yang suka mencela, sehingga kemenangan yang nyata, berhasil pada akhirnya.” Wallahua’lam.

Can Najib and BN fight fairly?

A rigged electoral rolls do not present a fair fight and he must not assume that the rakyat will remain stupid forever.

There have been successful attempts by certain crooked parties to give Malaysian citizenship to the vast number of foreign workers in Malaysia. Of course this citizenship comes with the clause that these said foreign workers must vote BN once they have obtained their citizenship.

A case in point is the state seat of Pelabuhan Kelang currently held by Badrul Hisham Abdullah (ex-PKR, now Umno state assemblyman) which has seen an increase of 5,510 new voters between the end of 2010 and the 3rd quarter of 2011.

This state seat is located in the parliamentary seat of Klang currently held by DAP’s Charles Santiago and as there have been no new housing developments in that said area since the previous general election, this increase is suspicious indeed.

Santiago has checked the voter rolls and has seen Indonesian names in the rolls and he has heard that citizenships are being expedited for the foreign workers to enable them to vote. He is worried about this increase and will file objections on those names.

He will also try to fix a meeting with the Election Commission (EC) officials to seek an explanation on this mysterious increase. The cost of filing an objection is RM10 per name and will come to a hefty sum when there are a few thousand names.

The cost is prohibitive as the Pakatan Rakyat (PR) MPs do not have the federal allocation of RM1.5 million per year that by right should be disbursed to them as they are the federal opposition.

The Prime Minister’s Department is holding on to this money and denying the Pakatan MPs their rightful allocations. Thus Pakatan MPs are cash-strapped.

There are also more than 5,000 suspicious names in the parliament seat of Shah Alam (PAS’ Khalid Samad) and more than 5,000 in the parliament seat of Kuala Langat (PKR’s Abdullah Sani).

Jan 10: Pakatan Rakyat will launch its long awaited common manifesto for the coming general election during its convention in Alor Star this Saturday.

Convention secretariat director Phahrolrazi Zawawi (pic) said the convention bringing together leaders from PAS, PKR and DAP would be held at the Sultan Abdul Halim stadium, and will be followed by a rally in the evening, during which the manifesto will be officially launched.

The rally will begin with a prayer congregation and a religious lecture by PAS's Dr Haron Din, followed by speeches by PR top leaders.

Phahrolrazi, who is also Kedah PAS's deputy commissioner, said some 100,000 people were expected to attend the event which is being held for the third time.

The opening address will be delivered by Kedah Menteri Besar Azizan Abdul Razak, followed by speeches by DAP Youth leader Anthony Loke, PAS secretary general Mustafa Ali and his counterpart from PKR Saifuddin Nasution.Other personalities include national laureate A. Samad Said, academic Dr Abdul Aziz Bari, as well as representatives from Felda, civil service, NGOs and students organisations.

The convention, themed 'Clean Up Malaysia', will be concluded with speeches by PAS Murshidul Am Tuan Guru Nik Abdul Aziz Nik Mat, PKR de-facto leader Anwar Ibrahim, DAP chairman Karpal Singh and secretary general Lim Guan Eng, among other top party leaders.

Harakahdaily IPOH, 10 Jan: Dewan Pemuda PAS Perak hari ini membuat serahan notis tuntutan ganti rugi RM600 ribu kepada pemuda Umno negeri ekoran kenyataan mengaitkan Unit Amal PAS dengan demonstrasi pelajar di hadapan Universiti Pendidikan Sultan Idris (UPSI) 1 Januari lalu.

Notis saman itu dibuat ke atas Pergerakan Pemuda Umno Negeri Perak dan Naib Ketuanya, Mohamad Annuar Ariffin.

Mereka yang diwakili Jabatan Undang-Undang dan Hak Asasi Manusia (Juham) membuat serahan itu di pejabat pergerakan itu dan diterima Pegawai Komunikasi Media Pemuda Umno Perak, Syed Afzarizal Syed Salim.

Mengetuai penyerahan itu adalah Peguam dan Pengarah Undang-Undang Pemuda PAS Perak, Mohammed Zamri Ibrahim, manakala turut serta, Penolong Setiausaha Pemuda PAS Perak, Safarizal Saleh, Exco Pemuda PAS Perak, Mohd Hakimi Syah Alani, Zairul Azrun Zainal Abidin dan Pengarah Jabatan Amal Negeri Perak, Arif Sha'arani.

Dalam satu kenyataan, Safarizal berkata Pemuda PAS Perak akan menunggu tempoh yang telah dinyatakan bagi tujuan tuntutan ganti rugi tersebut dan akan terus mengambil tindakan susulan mengikut lunas undang-undang jika Pemuda Umno Perak dan Annuar masih gagal menjelaskan ganti rugi yang telah dikemukakan.

Sebelum ini, mereka memberi tempoh tiga hari bermula 4 Januari lalu kepada Mohamad Annuar untuk menarik balik kenyataannya dan memohon maaf.

Bagaimanapun, sehingga tempoh itu tamat, mereka mendakwa tiada sebarang tindakan dibuat Naib Ketua Pemuda Umno Perak itu.

Sehubungan itu, mereka hari ini menyerahkan notis ganti rugi sebelum mengambil tindakan undang-undang yang sewajarnya.

KUALA LUMPUR, Jan 9 — Mohd Saiful Bukhari Azlan wants the prosecution to appeal against the acquittal of Datuk Seri Anwar Ibrahim by the High Court here today.

The former aide of the opposition leader said in a blog posting today that, while he respected the “decision today that did not go my way,” he had the right to pursue the matter to the higher courts.

“Therefore, me and my family hope the public prosecutor will file and take this case to the Court of Appeal,” he wrote.

Trial judge Mohd Zabidin Mohd Diah ruled today that the prosecution had not done enough to prove Anwar had committed sodomy against Saiful.

Anwar, 64, was similarly indicted of sodomy over a decade ago and found guilty. He spent six years in jail before being exonerated.

The former deputy prime minister has maintained that his prosecution for sodomy was politically-motivated and a plot to kill his political career.

Today’s verdict defied the expectations of political observers and even Anwar, who had alleged that a guilty verdict was predetermined.

Saiful, who accused the PKR de facto leader of sodomising him in June 2008, said he put his faith in Allah whose “plans are far greater than man’s.”

“As Allah’s servant, I believe everything that happens is for a good reason. My faith in Allah is still firm,” he said.

Saiful was not present for the verdict at the Jalan Duta Court Complex this morning, where thousands had gathered to lend support to Anwar.

JAN 10 — When I wrote about how “The law has truly become an ass” back in February 2010 on the battle of the two mentris besar in the Perak power grab impasse, I meant it.

I was totally disgusted and appalled by the apex court finally returning a verdict of 5-0 in favour of Zambry Abdul Kadir over Nizar Jamaluddin, and whatever little regard I had for the judiciary entirely dissipated with that decision. It has never recovered since.

The High Court’s acquittal of former Deputy Prime Minister Anwar Ibrahim yesterday has not changed my opinion of the judiciary either. And it’s not just about being a sceptic as the saying “a swallow doesn’t make a summer” suggests. It’s also not about the presiding judge not dismissing this frivolous case from the outset.

Lest you’re still wondering about my despondency and disdain for the judiciary, it’s all about the extreme humiliation we are subjected to as the country is being given global real-time coverage by CNN and Al-Jazeera, et al... all because of Malaysia’s obsession with someone’s anal virginity.

If Mohd Saiful Bukhari’s allegation of being sodomised eight or nine times over a period of two months by a 60-plus-old man with a bad back is to be believed, it doesn’t take a pundit to tell you that the predator must by now be whipped and jailed.

Given the firepower of the government machinery, both overt and covert, and better still for the investigating team, that it’s the second sodomy charge against Anwar, you would have thought they’d be able to prove this charge beyond the shadow of reasonable doubt! All the more if the government truly believes that this one man is Public Enemy No. 1!

But alas, by God’s grace, mercy and infinite knowledge, and to the amazement and shock of everyone present in court yesterday morning, a verdict of “acquittal and discharge” was handed down by the judge Mohamad Zabidin Mohd Diah in less than three minutes. I was in court and like everyone else was simply dumbfounded! Again, this former deputy PM has been exonerated.

I had been willing to accept any verdict and in fact scenario-planned all eventualities. Every scenario, best and worst case, has its upside and downside for both sides i.e. the federal government (Barisan Nasional) and the opposition (Pakatan Rakyat).

But to have the BN leaders, including the PM, unashamedly telling the rakyat that the judiciary is independent and credible because it acquitted Anwar is certainly the first darnedest thing said in 2012 in the political arena.

At the start of the new year, respected blogger Marina Mahathir called for a “End Stupid Statements” campaign. It looks like we really need one after reading and hearing some of the statements made after yesterday’s verdict.

Lest you fail to see the perverted logic of the BN leaders’ statement, let’s try a different scenario where the verdict came back as “guilty”. Is the PM and other leaders saying that if the court found Anwar guilty of sodomy, the judiciary is no longer independent and credible?

This is idiocy and lunacy of the severest degree! A judiciary that is independent and has integrity is not judged by a single verdict. It has to gain the trust and respect of the entire citizenry through doggedly delivering justice without fear or favour. Every time.

As if that statement of Anwar’s acquittal proving the judiciary is indeed independent wasn’t moronic enough to make this nation a laughing stock again in the eyes of the global legal community, former Prime Minister Tun Dr Mahathir Mohamad, alleged by many to be the master strategist of Sodomy1 and perhaps as claimed by some to be working in concert with the current administration in Sodomy 2, declares that the acquittal proves there is no conspiracy against Anwar.

Despite the 87 days of court hearing, 27 witnesses for the prosecution team, the judge could rule that the prosecution had not done enough to prove Anwar had committed sodomy.

And it is not a conspiracy? Good try, old man, we wish we could believe you.

It’s not that the prosecution had not done enough. There was simply not enough evidence.

And finally, the cost of the all this legal wrangling. Who bears it? And how much exactly? And Saiful is now mulling an appeal.

The buck stops with you, Mr PM! Let’s stop this gutter politics. Let’s all make a commitment to build this country of ours to a great and respectable nation again.

Yes, we are in a zero-sum game, but let it be on the plane of policy advocacy, performance, and political-intellectual acumen and not a destructive gutter politics of the worst order. Let us be a functional democracy and stop doing more of the same things.

This is the path to genuine reform and redemption.

If we are in denial, we shall do it at our peril and we will die by our own swords!

901 : Not a great day for justice.

JAN 9,2012 — I have to break up the party but it is a sad day when we Malaysians are celebrating an acquittal which would HAVE been an acquittal in any democracy.

Please stop calling the judge a hero or brave person or hailing the government for not interfering in the judiciary. It is embarrassing because we once had one of the most respected judiciaries in the Commonwealth and now we are celebrating one enlightened decision.

This is the equivalent of being Olympians at football and then celebrating a win at regional level. (Oh sorry, we actually did this also.)

I don’t know Anwar Ibrahim and I think Anwar is a poor judge of people (Mahathir Mohamad, Eskay Abdullah, Zulkifli Noordin, Ezam, Saiful, etc) but this sodomy case was very weak. The offence was consensual but Saiful alleged that he was forced into the act and then there were the multiple screw-ups.

If the judge had applied his mind properly, the defence should not have been called. If I recall correctly, he read out a long judgment in court where he seemed to have made up his mind on Saiful’s evidence even without the benefit of other evidence.

The defence was called and the government’s expert witnesses were shown up badly. By the way, should we even bother to trust the government’s DNA expert?

So today the only possible outcome was reached and the government issues a statement saying that the decision shows the independence of the judiciary. So is the government saying that before this decision there was interference from Putrajaya?

Others are saying that this court decision shows the potency of the administration’s reforms. But didn’t the government hail judicial independence.

The days have long gone when we should be excited at something which was the norm in Malaysia from independence until the 1980s: true freedom enjoyed by institutions in the country.

May I also remind those claiming a victory for reform that such a sentiment was also exuded after the Federal Court freed Anwar under Abdullah Ahmad Badawi... need I remind Malaysians about the power grab in Perak after that.

So, enjoy the freedom of one man but don’t read too much into anything.

Anwar’s and family’s security upped after bodyguard ‘attacked’

KUALA LUMPUR, Jan 8 — Security measures for Datuk Seri Anwar Ibrahim and his family are being beefed-up, following “a botched attack” involving Datuk Seri Dr Wan Azizah Wan Ismail last night.

“There will be more security measures for the family. We have to be more careful now,” PKR vice president Chua Tian Chang told The Malaysian Insider.

According to his fellow vice president, Nurul Izzah Anwar, bodyguard Fayyadh Afiq Albakqry was escorting PKR president Dr Wan Azizah (picture) through a crowd of supporters at a ceramah near her hometown in Penang at about 10pm when the alleged attack happened.

“He’s now hospitalised in Seberang Jaya hospital. He was attacked with a syringe as he was shielding Dr Wan on her way up to the podium to speak.

“He later passed out in the car in the presence of Dr Wan, my sister Ilham and her husband,” Nurul Izzah, who is Anwar and Dr Wan Azizah’s daughter told The Malaysian Insider in a text message.

Nurul said a police report was lodged at 12.40am.

Anwar was in Kuala Terengganu attending another rally when the alleged attack happened.Anwar will be ending his whirlwind six-day tour ahead of the Sodomy II trial verdict tomorrow with “two grand finales”, one in Kampung Baru, and another in Kampung Pandan.

His family and PKR leaders are expected to be by his side throughout the night.News of the alleged attack have spread rapidly through Twitter with some individuals claiming that Fayyadh may have prevented an attack on Wan Azizah.Chua however said it was too early to speculate the motive and target of the attacker.

Fayyadh is also the same bodyguard who was allegedly struck with a tear gas canister while protecting Anwar during the Bersih 2.0 rally.PKR deputy president Azmin Ali had announced on Tuesday that Pakatan Rakyat (PR) will be amassing a rally of over 100,000 people when the court delivers its verdict on Monday.

Anwar, 64, is charged with sodomising former male aide Mohd Saiful Bukhari Azlan at a condominium in upscale Damansara Heights here in June 2008, a few months before returning from a decade in the political wilderness and winning back his Permatang Pauh parliamentary seat.

This represents the second time he has been prosecuted for sodomy.If found guilty, he could spend up to 20 years behind bars but will escape the caning penalty as he is over 60. It would effectively spell the end of his political career and his chance to be prime minister.

COMMENT And finally, PAS shows Dr Hasan Ali the door. The opinions about him range from those in the rabid anti-Hasan group, a big number of whom could only now see the 'evils' of the Barisan Nasional government, to those who think that Hasan's exit would mean PAS becoming less Islamic in its character and objectives.

Several weeks after my graduation, I joined PAS organ Harakah and was made in charge of its English Section. It was the best of times and the worst of times: it was the peak of the reformasi period and Malaysia's drift into a police state. It was also a period when over 350,000 copies of Harakah were being sold every edition, just like hot cakes, only better.

One of my first assignments was to interview Hasan, who had then just joined PAS amid much fanfare and jubilation among PAS members. Pictures of him passing the membership form to then PAS president, the late Fadzil Noor, were splashed almost on every issue of Harakah.

The celebratory mood in PAS was understandable: Hasan was of course a good catch. His clean shaven image and established reputation as a well-liked motivational speaker were after all a welcome development for a party that had, until then, taken pains to show that it was not the village party that a small clique of self proclaimed 'liberals' in the mainstream media would depict it to be.

My first impression of Hasan was not far off from the one I had formed about him during the many times he appeared on the government television channel. To begin with, I never had high expectation for a motivational speaker. This view about motivational speakers is now permanently cemented into my psyche based on a true rags-to-riches story of a friend. This fellow was a miserable failure in his studies and would appear in class only during an examination. Of course he never did get his degree. Nowadays, I have been told that he gives motivational talks to students on how to achieve good grades!

Hasan of course was more qualified academically than this friend of mine. But much of the contents of his talks and speeches has not been reflective of someone who is widely read and recognised as an expert on Islamic subjects.

"Jadi jika Datuk Seri Anwar akan dipenjarakan, mereka secara automatik menjadi tertanya-tanya siapakah pula yang akan menjadi Perdana Menteri," katanya pada program Kempen Bebaskan Anwar 901 di padang Kelab Sultan Sulaiman, di sini, malam ini.

Pada program yang dihadiri ribuan orang ramai itu, beliau menegaskan, perralihan rakyat daripada BN kepada Pakatan Rakyat berpunca dari kezaliman Kerajaan BN yang ditunjangi Umno itu sendiri terhadap rakyat sejak BN memerintah negara sejak sekian lama.

"Namun rakyat bukan lembu, malah semakin cerdik dan mereka telah bersama-sama bangkit untuk melepaskan diri dari kezaliman Umno BN," katanya.

Realiti di negara ini sekarang, tegasnya, samalah seperti di Tunisia yang telah sekian lama berada di bawah pemerintahan zalim Ali Zainal Abidin, sehingga memaksa rakyat terutama golongan muda bangkit di jalan-jalanraya untuk menggulingkan pemerintahan Ali Zainal Abidin.

Katanya, punca kezaliman Ali Zainal Abidin terhadap rakyat disebabkan sikap isterinya, Laila yang begitu gelojok mengumpulkan jongkong emas dan kekayaan keluarganya.

Manakala di negara ini, isteri Perdana Menteri Datuk Seri Najib Razak, Datin Rosmah Mansor pula turut bersikap seperti itu apabila begitu berminat mengumpulkan cincin dan permata.

Selain itu, rakyat juga semakin sedar, hutang negara kini semakin meningkat sehingga melebihi RM400 bilion, manakala indek rasuah yang melibatkan para pemimpin kerajaan turut meningkat setiap tahun.

"Jika beberapa tahun lalu indeks rasuah negara ini sekitar 5.10 peratus, tahun lepas meningkat kepada 4.9/10 dan tahun lalu kepada 4.8/10.

"Ini menunjukkan negara ini pasti akan bangkrap jika dibiarkan terus diperintah oleh BN," tegasnya.

Beliau menegaskan, walau apa pun yang berlaku terhadap Anwar esok, PAS dan Pakatan Rakyat tetap bersama pemimpin tersebut.

Oleh itu, beliau menyeru supaya seluruh penyokong Pakatan Rakyat hadir di kaeasan perhimpunan di kawasan parking kereta di Kompleks Mahkamah Kuala Lumpur esok bagi menyatakan kebersamaan dengan Anwar walaupun dalam pelbagai keadaan.

Malaysia's High Court says no to overseas ‘absent voters’

The Malaysian Insider : KUALA LUMPUR, Jan 6 — The KL High Court dismissed today the application of six Malaysians residing in Britain to be registered as absent voters in the next general election.

The six are Dr Teo Hoon Seong, electrical engineer V. Vinesh, entrepreneur Paramjeet Singh, Dr Yolanda Sydney Augustin, translator Sim Tze Wei and software architect Leong See See.

Their lawyer Edmund Bon submitted that the Election Commission had acted illegally and irrationally when it rejected the application of the six, and also failed to give any reason or basis to justify their exclusion.

The EC’s regulations define an “absent voter” only as citizens who are members of the armed forces, public servants, full-time students, or their spouses, and thus allowed to cast postal votes.

Article 119 of the Federal Constitution, however, broadly defines “absent voters” as voters so long as they are citizens above 21 years of age, and are registered as electors for their respective constituencies.

Today, judge Datuk Rohana Yusuf ruled that the applicants “clearly” did not come under the allowed absent voter category.

She pointed out that the six were not challenging the validity of Regulation 2 of the Elections Act, which defines the term “absent voter”, calling it “odd” that they are disputing a “perfectly valid” decision of the EC.

On October 25 last year, the plaintiffs applied for judicial review to compel the EC to register them as absent voters in the next general election.

They had sought a declaration that, as Malaysians staying abroad, they were entitled to be registered as absent voters, and directed the EC, named as the sole respondent, to register them.

They also sought to quash a decision by the EC, which notified them in a letter dated September 9 the same year, that it would not register them as “absent voters”.

Today, Rohana described the plaintiffs’ argument as “naïve and ignorant”, adding that the regulatory and administrative arms of the EC were two separate powers.

“The application, in my view, is ludicrous and bordering an abuse of the court process,” she said.

:KEZALIMAN TINDAKAN FRU MEMBELASAH MAHASISWA DALAM MENYURAIKAN “HIMPUNAN” DI UPSI.

Persatuan Mahasiswa Universiti Kebangsaan Malaysia (PMUKM) memandang serius akan tindakan yang diambil oleh Federal Reserve Unit (FRU) dalam menangani isu yang berlaku di Universiti Pendidikan Sultan Idris (UPSI) pada awal tahun baru 2012.

PMUKM menyelar sekeras-kerasnya tindakan FRU membelasah mahasiswa dalam menyuraikan perhimpunan di UPSI. Pengerusi BEBAS, Saudara Safwan Anang di laporkan kritikal dan beberapa mahasiswa lain yang turut tercedera dengan tindakan zalim pihak polis.

Ini merupakan satu tindakan yang tidak wajar kerana secara terang-terangan bertentangan dengan roh Perlembagaan Persekutuan yang sememangnya memberi hak kebebasan kepada rakyat untuk berhimpun dan menyuarakan pendapat.

Sekalipun himpunan ini dilihat sebagai satu perkara yang boleh mengganggu-gugat keselamatan awam, pihak polis tidak sewajarnya menggunakan kekerasan dalam menangani himpunan ini kerana mereka hanya berdepan dengan mahasiswa dan bukannya penjenayah bersenjata.

Tindakan yang diambil pada waktu kejadian seolah-oleh menggambarkan pihak polis terlalu terdesak seolah-olah tiada jalan lain dalam menangani himpunan tersebut. Ini sama sekali tidak sesuai di lakukan dalam negara yang mengamalkan demokrasi.

Sikap “double standard” polis juga terlihat apabila sebelah pihak yang menyokong kerajaan membuat demostrasi di Putrajaya pada 21 Disember baru-baru ini tidak pula dikenakan apa-apa tindakan, sebaliknya kekerasaan diperlakukan kepada mahasiswa yang tidak sehaluan dengan kerajaan.

Seharusnya pihak polis menjadi badan yang bertanggungjawab dalam memastikan keharmonian, keadilan, dan kesaksamaan semua pihak khususnya rakyat jelata dan bukannya bertindak di luar peri kemanusiaan.

Oleh itu, PMUKM mendesak supaya Ketua Polis Negara, Tan Sri Ismail Omar Rabu supaya bertanggungjawab atas tindakan kejam pihak polis terhadap mahasiswa yang berhimpun di UPSI pada awal tahun baru 2012.

Demo UPSI: Siswa cedera, 20 ditahan

Kira-kira 20 aktivis mahasiswa ditahan polis dan seorang cedera dalam perhimpunan prokebebasan akademik di depan Universiti Pendidikan Sultan Idris (UPSI) di Tanjung Malim malam tadi.

Menurut saksi, Presiden Gerakan Menuntut Kebebasan Akademik Muhammad Safwan Anang dibawa ke hospital berdekatan setelah gagal mendapat rawatan di klinik berdekatan.

Dakwanya, mulut pemimpin mahasiswa itu kelihatan berdarah setelah cuba diredakan polis dalam perhimpunan yang disertai kira-kira 60 itu.

Solidariti Mahasiswa Malaysia (SMM) dalam Twitter mereka mengesahkan Muhammad Safwan dibawa ke Hospital Tanjung Malim sebelum dipindahkan ke Hospital Slim River.

Pemimpin Pemuda PKR Rozan Asen Mat Rasip -- yang kemudiannya berkumpul bersama NGO yang rapat dengan Pakatan Rakyat -- di balai polis tempat mahasiswa ditahan berkata, beliau difahamkan Muhammad Safwan dalam keadaan serius.

Antara yang ditahan Presiden Kumpulan Aktivis Independen Mahasiswa (KAMI) Haziq Abdullah Abdul Aziz dan aktivis Parti Sosialis Malaysia (PSM) Mandeep Singh.

1. In the past few weeks, the MACC has been very prolific. Many advertorials have been published in the main stream newspapers of the MACC’s achievements in eradicating corruption. The conviction of former Selangor MB Dato Seri Khir Toyo to 1 year imprisonment seems to boost the MACC’s image.

2. The MACC blazed the trail again when on the 21st December 2011, the MACC announced the arrest of five (5) civil servants for bribery in separate places in Kedah. On Tuesday 27th December 2011, the husband of the ex-CEO of the Iskandar Investment Board (IIB), Mohd Amin Suhaimi, was charged in Johor Bharu for corruption. It seems strange that the ex-CEO herself was not charged. Then on Wednesday 29th December, a former IIB senior V-P, Rostam Razali, was fined RM20,000 after he pleaded guilty for abuse of power in disclosing confidential tender price information.

3. Meanwhile in KL, the Permanent Chairman of Malaysian Muslim Welfare Organisation (Perkim) Selangor branch who was also the former International Islamic University Malaysia (IIUM) Deputy Rector, Professor Emeritus Datuk Dr Ariffin Suhaimi, was charged with two other Perkim members, Dato’ Baharin Baba, 58, and Abas Adam, 60 for Criminal Breach of Trust (CBT) by the MACC. The offence was alleged to have happened in the early 2000s.

4. While all these seem to show that the MACC would have the stamina and resolve to dig at old records to uncover corruption, abuse of power and CBT, the public has not forgotten the persecution of Dato’ Ramli Yusuff, the former Director CCID, and his lawyer, Rosli Dahlan. The public considers this as a fix-up job by former IGP Tan Sri Musa Hassan and A-G Gani Patail achieved with the collusions of the MACC. Musa Hassan was exposed as an incredible witness which is a legal euphemism for calling him a liar. Because of that, the public considers the MACC as a tool of oppression that would do the biddings of A–G Gani Patail and their political masters.

5. Thus, some skeptics say that these recent events are merely to allow the MACC to end 2011 on a high note. It is as if the MACC is trying to erase all the bad publicity for causing the deaths of Teoh Beng Hock and customs officer Ahmad Sarbaini while in the MACC’s custody. The outcome of the Royal Commission of Inquiry and the Inquest have not satisfied the public’s thirst for the truth and justice. Rightly or wrongly, that is the public perception. And perception counts if the government of PM Dato Seri Najib Tun Razak is to lead BN to a successful GE 13.

6. In that regard, I feel compelled to raise the two blatant cases involving YB Senator Dato’ Seri Shahrizat Abdul Jalil, Minister for Women and Family Development, in the NFC episode and YB Senator Datuk Dr. Awang Adek Hussein, Deputy Minister of Finance, for admitting he received cash into his private accounts but justified it as for political donations towards social program.

7. Like the rest of the Rakyat, I am astounded and appalled by the reasons put up by both these two politicians who were rejected by the Rakyat in GE 12 and had to be smuggled into the Cabinet by back door appointments through the Dewan Negara. Their mere presence as Ministers in the Government betrays everything that PM Najib has been saying about winnable candidates. These two were rejected by the Rakyat in GE12 and their involvement in these two scandals will certainly not endear them any closer to the electorates in GE 13.

8. In the case of Dato’ Seri Shahrizat, the evidence are already in the public domain of the misappropriation of the NFC funds granted for the national cattle project instead being used to purchase luxurious condominiums, super cars and fantastic salaries for Shahrizat’s husband and children.

9. The initial statement by the MACC that they only investigate corruption cases and referred the matter to the Police is seen as a feeble attempt to pass the bucket. That was the same thing that happened in the Khir Toyo’s case until I pursued it that led to Khir Toyo being charged. Even so, the Rakyat questioned why Khir Toyo was charged under the Penal Code where the maximum penalty is only 2 years whereas punishments under the MACC Act would extend to 20 years. The Rakyat sees this as a cover up!

10. In the case of Datuk Dr. Awang Adek, his open admission of having received such monies to fund his own “social” programs actually constitute political gratification. That an offence of corruption has been established could not be clearer. But most worrisome to me is the inability of Awang Adek, as our Finance Minister, to realise that what he had done was wrong. For him to justify his conduct spells doom for the country if our national finance is to be managed by a man of such moral fabric.

11. I invite the MACC Chief Commissioner, Dato’ Sri Abu Kasssim, to deliver to both Shahrizat and Awang Adek the lectures that he had delivered to me when I was on the MACC Advisory Panel about the meaning of gratification. Since I am now pursuing a law degree, for these Ministers’ benefit I reproduce s. 3 on Interpretation in the MACC Act:

"gratification" means-

(a) money, donation, gift, loan, fee, reward, valuable security, property or interest in property being property of any description whether movable or immovable, financial benefit, or any other similar advantage;

12. For Sharizat to maintain that her family is justified to get the contracts goes against the provisions of the MACC Act:

23. Offence of using office or position for gratification

(1) Any officer of a public body who uses his office or position for any gratification, whether for himself, his relative or associate, commits an offence.

(2) For the purposes of subsection (1), an officer of a public body shall be presumed, until the contrary is proved, to use his office or position for any gratification, whether for himself, his relative or associate, when he makes any decision, or takes any action, in relation to any matter in which such officer, or any relative or associate of his, has an interest, whether directly or indirectly.

13. Let me ask Awang Adek, if he is not the Deputy Finance Minister whether these companies and associates would give him those monies to fund his political programs. The case of Dato’ Harun Idris is on point. That makes it clear that Awang Adek had accepted gratification as defined by s. 16 MACC Act:

16. Offence of accepting gratification

Any person who by himself, or by or in conjunction with any other person--

(a) corruptly solicits or receives or agrees to receive for himself or for any other person; or

(b) corruptly gives, promises or offers to any person whether for the benefit of that person or of another person,

any gratification as an inducement to or a reward for, or otherwise on account of--

(A) any person doing or forbearing to do anything in respect of any matter or transaction, actual or proposed or likely to take place; or

(B) any officer of a public body doing or forbearing to do anything in respect of any matter or transaction, actual or proposed or likely to take place, in which the public body is concerned,

commits an offence.

14. As a Minister, Awang Adek is a public officer. Thus, his acceptance of such monies into his personal account constitutes bribery:

21. Bribery of officer of public body

Any person who offers to an officer of any public body, or being an officer of any public body solicits or accepts, any gratification as an inducement or a reward for--

(a) the officer voting or abstaining from voting at any meeting of the public body in favour of or against any measure, resolution or question submitted to the public body;

(b) the officer performing or abstaining from performing or aiding in procuring, expediting, delaying, hindering or preventing the performance of, any official act;

(c) the officer aiding in procuring or preventing the passing of any vote or the granting of any contract or advantage in favour of any person; or

(d) the officer showing or forbearing to show any favour or disfavour in his capacity as such officer,

commits an offence, notwithstanding that the officer did not have the power, right or opportunity so to do, show or forbear, or accepted the gratification without intending so to do, show or forbear, or did not in fact so do, show or forbear, or that the inducement or reward was not in relation to the affairs of the public body.

15. Once Awang Adek admitted that he had accepted gratification, then there is a presumption that it is corrupt gratification:

50. Presumption in certain offences.

(1) Where in any proceedings against any person for an offence under section 16, 17, 18, 20, 21, 22 or 23 it is proved that any gratification has been received or agreed to be received, accepted or agreed to be accepted, obtained or attempted to be obtained, solicited, given or agreed to be given, promised, or offered, by or to the accused, the gratification shall be presumed to have been corruptly received or agreed to be received, accepted or agreed to be accepted, obtained or attempted to be obtained, solicited, given or agreed to be given, promised, or offered as an inducement or a reward for or on account of the matters set out in the particulars of the offence, unless the contrary is proved.

16. It is abundantly clear that the actions of Shahrizat and Anwang Adek are not defensible. The MACC does itself discredit if it continuously refuse to act with the same speed and efficiency when it involve members of the ruling party. The Rakyat is tired of excuses. In the interest of the BN Government, Shahrizat and Awang Adek should resign and offer themselves for investigation by MACC and other authorities. By resigning, only then can investigations against them be done without the undue influence which cannot be the case if they remain in the Cabinet.

17. As we celebrate New Year, the Rakyat expect a new resolve by the Government and the MACC. If the fight to eradicate corruption is seen as mere lip service, the Rakyat will rise and teach the government a lesson at the ballot box. Before that happens, I urge the government to wake up to today’s realities before the Rakyat say enough is enough!

Shamsubahrin charge ‘diversion’ from NFC scandal, says Pakatan.

KUALA LUMPUR, Dec 31 — The cheating charge against Datuk Shamsubahrin Ismail is an attempt to divert attention away from the National Feedlot Corporation (NFC) scandal, Pakatan Rakyat leaders claimed today.

The opposition pact leaders added that allegations of misappropriating public funds linked to the national cattle farming project remain unanswered.

The case has been linked to minister Datuk Seri Shahrizat Abdul Jalil’s family. Her husband, Datuk Dr Mohamad Salleh Ismail, is the NFC chairman and chief executive while their children help run the business.

Shamsubahrin, 45, was charged at the Sessions Court yesterday with cheating Mohamad Sallehout of RM1.76 million in consultation fees by offering the latter fraudulent advisory services.

“The charge brought against Shamsubahrin Ismail shocks the nation and will go down in Malaysian history as the most ridiculous diversion ever attempted.

“The NFC scandal has reached the temperature that the public demands immediate action to recover all the public money spent and bring those responsible for the misappropriation to be accountable,” PKR chief strategist Rafizi Ramli (picture) told The Malaysian Insider.

He pointed out that the evidence disclosed to the public so far had been “compelling” and and that it has not been denied “even once” by the NFC, Shahrizat, or any other Umno leader from the ruling coalition.

“That Umno leadership thinks they can make Malaysians believe that the NFC leadership is a victim of a fraud perpetrated by Shamsubaharin, just proves that Umno has lost the plot.

“By the strength of this evidence alone, in other countries with a functioning rule of law (this) would be sufficient to bring Datuk Seri Shahrizat and her family to justice,” added the PKR leader.

Rafizi said that PKR would pursue the issue and make sure that the people responsible for approving the project and soft loans are brought to justice.

“PKR will make new revelation next week on NFC - if Umno refuses the rule of law to judge those responsible, then let the court of public opinion judges Umno and its leadership for its failure to act on NFC.”

DAP central executive committee (CEC) member Liew Chin Tong said that the charge against Shamsubahrin did not provide any explanation to how federal funds for a cattle project were used to purchase luxury condominiums.

“By charging him it does not mean the original case has gone away.

“Morally, politically something has to be done. Allegations on abuse of funds have to be answered,” he told The Malaysian Insider.

The Bukit Bendera MP said that the government should make public the papers and documents relating to NFCorp’s cattle project, and that complete transparency was the way to solve the debacle.

Police are investigating NFCorp for alleged criminal breach of trust, following accusations by PKR that the company had misused millions in federal funds meant for a cattle feedlot scheme.

The Malaysian Anti-Corruption Commission (MACC) announced last week it would investigate claims that NFCorp had misappropriated government funds, despite previously saying it would not probe the matter.

The MACC later seized a computer CPU and several documents during a raid on NFCorp’s headquarters in Solaris Mont Kiara.

PKR first latched onto the issue after the RM250 million publicly-funded cattle project — run by Mohamad Salleh, husband to federal minister Shahrizat - made it into the pages of this year’s Auditor-General’s Report for failing to meet production targets. The opposition party has since made several revelations relating to the scandal, including NFCorp’s purchase of two multi-million ringgit condominium units in Bangsar and alleged use of project funds to Shahrizat and her family’s personal expenses and trips abroad.

It also claimed there was a transfer of resources to unrelated companies in Singapore, as well as the purchase a Mercedes-Benz CLS350 for RM534,622 and two plots of land in Putrajaya’s Precinct 10 for RM3,363,507.

The latest disclosure by PKR, made last Tuesday, further alleged that some RM10 million had been diverted towards the purchase of a luxury condominium unit in Singapore for Shahrizat’s family.

Shahrizat tried deflecting attention by stating she’s “only the wife” of the national cattle farming project’s chairman and had nothing to do with the NFC.

The senator has faced calls to quit as minister from within Umno, including from influential former prime minister Tun Dr Mahathir Mohamad.
